1. Acceptance of these Terms
These Terms form an agreement between you and xilistudios OÜ for your use of the xili mobile app, website, and related services. If you do not agree, do not use xili.
Additional terms from Apple, Google, Firebase, RevenueCat, Expo, Google Mobile Ads, or other third-party services may also apply when you use features connected to those providers.
2. Eligibility
You must be at least 13 years old to use xili. If the law where you live requires a higher age or parental consent for online services, you may use xili only if you meet that requirement.
If you use xili on behalf of someone else or allow a minor to use xili, you are responsible for making sure that use complies with these Terms and applicable law.
3. Your account
You may sign in using supported providers such as Google or Apple. You are responsible for keeping your device, provider account, and xili account secure.
You agree to provide accurate account and profile information, keep your username and profile content lawful, and avoid impersonating another person or organization.
We may refuse, reclaim, or change usernames, profile images, biographies, or other account details that violate these Terms, infringe rights, mislead users, or create safety or operational issues.
4. What xili does
xili is designed to make social posting less staged. The app selects a random image from your device gallery, lets you move through the posting flow, and unlocks friends' posts after you publish or use another eligible unlock method.
The experience intentionally includes uncertainty, rerolls, locked feeds, friend interactions, comments, ratings, notifications, rewards, gems, and other mechanics that may change over time.
5. Random photos, gallery access, and publishing
You are responsible for reviewing what you publish. Because xili is based on random gallery selection, a selected photo may be personal, sensitive, embarrassing, owned by someone else, or inappropriate to share. Do not publish it unless you have the rights and permission to do so and it complies with these Terms.
xili does not require you to upload your entire gallery. The app uses gallery permission to select eligible images and only uploads photos you publish as posts or choose as profile images.
You may not try to bypass, manipulate, automate, spoof, or break xili's random selection, reroll, posting verification, feed locking, reward, or unlock systems.
6. Your content and license to xili
You keep ownership of photos, captions, comments, ratings, profile information, and other content you create or upload to xili.
By submitting content to xili, you grant xilistudios OÜ a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, compress, transmit, display, distribute, and otherwise use that content as needed to operate, provide, secure, and improve the service.
This license includes showing your content to other users according to xili's features, creating feed entries, sending notifications, displaying profile previews, preserving backups, enforcing rules, and operating support or safety tools.
You represent that you have all rights needed to submit your content and that your content does not violate law, privacy rights, publicity rights, intellectual property rights, or these Terms.
7. Friends, feeds, comments, ratings, and visibility
xili is designed around friend-first sharing, but no social feature is perfectly private. Other users may capture, save, screenshot, describe, or share what they can see.
Feed access may depend on posting, dates, friends, unlock status, gems, rewards, or other app logic. We may blur, lock, rank, hide, remove, expire, or restrict content according to product behavior, safety needs, legal obligations, or these Terms.
Comments, ratings, requests, notifications, and profile details may be copied or denormalized across app records so the service can display them quickly and keep social features working.
8. Purchases, gems, xauce, rerolls, rewards, and ads
xili may offer consumable in-app items such as gems, xauce, rerolls, unlocks, rewards, or similar app-only value. These items are not money, do not have cash value, and cannot be sold, transferred, exchanged, or redeemed outside xili unless we expressly say otherwise.
Purchases are processed through Apple, Google, RevenueCat, or other payment providers. Prices, taxes, refunds, chargebacks, and payment methods may be governed by the applicable store or provider rules.
Rewarded ads may grant app benefits only when the ad provider, device, network, and xili backend confirm eligibility. We do not guarantee that ads, rewards, rerolls, gems, products, pricing, or offers will always be available.
We may correct balances, reverse mistaken credits, limit rewards, disable suspicious transactions, or deny credits where we reasonably believe there has been error, abuse, fraud, technical failure, or violation of these Terms.
9. Acceptable use
You agree not to misuse xili or help anyone else misuse it.
- Do not post illegal, exploitative, hateful, harassing, threatening, non-consensual, sexually explicit, violent, self-harm, or otherwise harmful content.
- Do not post private information, intimate images, images of minors, copyrighted content, or content showing other people unless you have the rights and permission required to share it.
- Do not impersonate others, deceive users, manipulate ratings, spam, scrape, mass-message, or use xili for commercial solicitation without permission.
- Do not reverse engineer, attack, overload, bypass security, interfere with Firebase rules, abuse cloud functions, exploit purchases, spoof device integrity, or automate app behavior.
- Do not use xili in a way that violates law, platform rules, third-party rights, or the safety and privacy of other users.
10. Moderation and enforcement
We may review, remove, limit, lock, blur, hide, or preserve content and accounts if we believe it is necessary to operate xili, enforce these Terms, protect users, comply with law, or investigate abuse.
We may suspend or terminate accounts, remove rewards or balances, block features, reject usernames, disable purchases, or report serious issues to relevant authorities or platforms where appropriate.
We are not obligated to monitor all content and cannot guarantee that every issue will be detected or removed immediately.
11. Third-party services and app stores
xili relies on third-party services, including Firebase, Google Cloud, Apple, Google, Expo, RevenueCat, and Google Mobile Ads. Their services may be subject to their own terms and privacy policies.
If you download xili from the Apple App Store or Google Play, the store provider is not responsible for xili except as required by its own terms or applicable law. Store rules may control downloads, updates, purchases, refunds, and device requirements.
12. Privacy
Our Privacy Policy explains how xili collects, uses, shares, and protects information. By using xili, you acknowledge that your information will be handled as described in the Privacy Policy.
13. Service changes and availability
xili is evolving. We may add, change, suspend, or remove features, designs, content, rewards, currencies, prices, unlock methods, app-store listings, or availability at any time.
We try to keep xili working, but we do not guarantee uninterrupted access, error-free behavior, permanent storage, perfect random selection, perfect content visibility, or compatibility with every device, operating system, region, or network.
14. Disclaimers
xili is provided on an as-is and as-available basis. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free operation.
You use xili at your own discretion, especially when publishing randomly selected photos or interacting with other users. You are responsible for your content, your conduct, and your decisions to publish or share information.
15. Limitation of liability
To the maximum extent allowed by law, xilistudios OÜ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, content exposure, purchase issues, device issues, or service interruptions.
To the maximum extent allowed by law, xilistudios OÜ's total liability for any claim relating to the service will be limited to the greater of the amount you paid to xili for the service in the three months before the event giving rise to the claim or 50 USD.
Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.
16. Indemnity
To the extent allowed by law, you agree to defend, indemnify, and hold harmless xilistudios OÜ and its affiliates, officers, employees, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of xili, your violation of these Terms, your violation of law, or your violation of another person's rights.
17. Ending your use of xili
You may stop using xili at any time. You may also delete certain content through available app features or contact us at contact@xiliapp.com for account-related requests.
We may suspend, restrict, or terminate your access if you violate these Terms, create risk for xili or other users, abuse purchases or rewards, or if continued access would be unlawful or operationally harmful.
Sections that by their nature should survive termination will survive, including content licenses needed for existing operation, purchase records, disclaimers, liability limits, indemnity, dispute provisions, and enforcement rights.
18. Governing law and disputes
If you have a concern, contact us first at contact@xiliapp.com so we can try to resolve it informally.
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules.
You agree to the exclusive jurisdiction and venue of the courts located in Estonia for disputes arising from these Terms or xili, except where non-waivable consumer rights require otherwise. Nothing in these Terms limits rights you may have under non-waivable local law.
19. Changes to these Terms
We may update these Terms as xili changes. If changes are material, we will take reasonable steps to notify users, such as updating the date above, posting the new Terms, or providing an in-app notice where appropriate.
Your continued use of xili after updated Terms become effective means you accept the updated Terms.
